Terms of Service

1. General, scope

  • 1.1 The following general terms and conditions apply to all business relationships between VSB VISA SERVICE UG and the customer. The version valid at the time of the conclusion of the contract is decisive.
  • 1.2 Consumers in the sense of the business conditions are natural persons with whom a business relationship is entered into and who do not act in the exercise of a commercial or independent professional activity.
  • 1.3 Entrepreneurs in the sense of the terms and conditions are natural or legal persons or legal partnerships with whom a business relationship is entered into and who act in the exercise of a commercial or independent professional activity.
  • 1.4 Customers in the sense of the terms and conditions are both consumers and entrepreneurs.
  • 1.5 Deviating, conflicting or supplementary general terms and conditions, even if they are known, are not part of the contract, unless their validity is expressly agreed in writing.

2. Subject matter of the contract

VSB VISA SERVICE UG provides all services that are necessary to obtain visas from foreign missions or other authorities, as well as advice on passport matters, insofar as these do not affect the sovereign rights of the Federal Republic of Germany and do not constitute legal advice. Since the decision about issuing a visa or issuing a passport rests solely with the foreign missions or responsible authorities, VSB VISA SERVICE UG owes no success whatsoever. VSB VISA SERVICE UG undertakes only to provide services.

3. Offer and conclusion of contract

  • 3.1 The offers made by Visa-Service are non-binding. Changes remain reserved within Reasonable limits.
  • 3.2 By placing the order, the customer declares his binding offer to enter into a contract. Visa-Service will immediately confirm receipt of the customer’s order. The confirmation of receipt does not yet represent a binding acceptance of the order. The confirmation of receipt can be combined with the declaration of acceptance.
  • 3.3 The company VSB VISA SERVICE UG is entitled to accept the contract offer contained in the order within three days of receipt by the company VSB VISA SERVICE UG. VSB VISA SERVICE UG is entitled to refuse to accept the order – for example after checking the customer’s creditworthiness.
  • 3.4 It follows from the nature of the contractual relationship as a service contract that the obligation to remunerate the services provided also exists if an application for a visa or passport has not been complied with. In the event of a refusal to issue a visa or passport, the customer will be informed immediately.
  • 3.5 The text of the contract is saved by VSB VISA SERVICE UG and sent to the customer along with the legally binding terms and conditions by email after the contract has been concluded.

4. Right of withdrawal

  • 4.1 The consumer has the right to revoke his declaration of intent aimed at concluding the contract within three days of the conclusion of the contract. The revocation does not have to contain a reason and must be sent in writing to VSB VISA SERVICE UG, Kurfürstenstr. 114, 10787 Berlin, e-mail: info@visa-service.com, to be explained; Deadline is sufficient for the timely dispatch. If you withdraw your order, we will invoice you for the costs incurred up to the point in time of the withdrawal as well as a proportionate fee.
  • 4.2 The right of withdrawal expires if VSB VISA SERVICE UG has started to perform the service with the express consent of the consumer before the end of the withdrawal period. The right of withdrawal also expires if the consumer has initiated the performance of the service himself. The consumer initiates the execution of the service when he downloads the services provided by VSB VISA SERVICE UG. Furthermore, the consumer initiates the execution of the service by transmitting information or documents that are required for the execution of the service. This does not include information that is required for the conclusion of the contract.
  • 4.3 The company VSB VISA SERVICE UG reserves the right to start performing the service only after the three-day cancellation period has expired, unless the consumer has given prior express consent to the performance of the service or the consumer has not initiated this himself.

5. Remuneration

  • 5.1 The price offered is binding. This results from the internet price list valid at the time of the offer. Legal sales tax included in the price. The price is exclusive of the third-party costs also specified in the internet price list and plus the shipping costs also indicated in the internet price list. In the event of unforeseeable deviations from the third-party costs specified in the internet price list, the third-party costs actually incurred shall apply. The customer does not incur any additional charges when ordering by using the means of remote communication. The customer can pay the price by cash on delivery or on account. VSB VISA SERVICE UG reserves the right to exclude individual payment methods.
  • 5.2 The customer undertakes to pay the price within ten days of receiving the visa or passport. After this period the customer is in default of payment. During the delay, the consumer has to pay interest on the debt at a rate of 5 percentage points above the base rate. During the delay, the entrepreneur has to pay interest on the debt at a rate of 8 percentage points above the base rate. The customer will be charged € 5.00 for each reminder.
  • 5.3 The customer only has the right to offset if his counterclaims have been legally established or have been recognized by VSB VISA SERVICE UG. The customer can only exercise a right of retention if his counterclaim is based on the same contractual relationship.
  • 5.4 Payment on account is only possible if this has been expressly permitted by VSB VISA SERVICE UG. Payment in advance means that the payment must be credited to our business account no later than one working day before the documents are sent. If payment in advance has been agreed and has not been made on time, we will send the documents by courier as cash on delivery, whereby the costs are borne by the recipient.
  • 5.5 By placing the order with VSB VISA SERVICE UG, the client expressly agrees to receive the invoice exclusively in PDF format by email after the order has been completed.

6. Transfer of risk

  • 6.1 When sending the visa or passport, the risk of loss and change is transferred to the customer upon delivery of the visa or passport to the carrier, the carrier or the person or institution otherwise assigned to carry out the shipment.
  • 6.2 When downloading and sending data via the Internet, the risk of the data being lost or changed when the network interface is exceeded is transferred to the customer.

7. Data protection

  • 7.1 Customer data is stored and processed by VSB VISA SERVICE UG in compliance with the relevant provisions of the Federal Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG). The personal data of the customer are only acquired for specified, clear and legitimate purposes and are not stored for longer than necessary personally.
  • 7.2 The customer has the right to information and the right to correct, block and delete the stored data, unless they are required for the establishment, content or modification of the contractual relationship with VSB VISA SERVICE UG. A corresponding request should be sent to VSB VISA SERVICE UG, Kurfuersten Strasse 114, 10787 Berlin, email: info@visa-service.com.
  • 7.3 The company VSB VISA SERVICE UG does not pass on personal data of the customer including the house address and the email address to third parties. The service partners as well as the foreign missions and other authorities that require the transmission of the data for order processing are excluded from this. In these cases, however, the scope of the transmitted data is limited to the necessary minimum.

8. Liability

  • 8.1 In the case of slightly negligent breaches of duty, the liability of Visa-Service is limited to the foreseeable, contract-typical, direct average damage depending on the type of service. This also applies to slightly negligent breaches of duty by the legal representatives or vicarious agents of Visa-Service.
  • 8.2 Visa-Service is not liable to entrepreneurs for slightly negligent breaches of insignificant contractual obligations.
  • 8.3 The above limitations of liability do not apply to damage to life, body and health attributable to Visa-Service.

9. Final provisions

  • 9.1 Changes or additions to these terms and conditions must be made in writing. This also applies to the lifting of the writing requirement.
  • 9.2 The law of the Federal Republic of Germany applies. In the case of consumers who do not conclude the contract for professional or commercial purposes, the mandatory provisions of the country in which the consumer is habitually resident remain unaffected.
  • 9.3 If the customer is a merchant, the place of jurisdiction for all disputes arising from this contract is Berlin; however, VSB VISA SERVICE UG is entitled to sue the customer at his place of residence. The same applies if the customer does not have a general place of jurisdiction in Germany or has relocated his domicile or habitual residence abroad after conclusion of the contract or the domicile or habitual residence of the customer is not known at the time the action is brought.
  • 9.4 If individual provisions of the contract with the customer, including these general terms and conditions, are wholly or partially ineffective, the validity of the remaining contractual conditions remains unaffected. The wholly or partially ineffective regulation is to be replaced by a regulation whose economic success comes as close as possible to that of the ineffective one.
